1. Introduction
These Terms of Service ("Terms") govern your access to and use of VibeSEO, operated by Individual Entrepreneur "Sigma", registered in Kazakhstan, including the website located at https://vibeseo.dev, the VibeSEO application, APIs, hosted publishing pages, and related services (collectively, the "Service").
By accessing or using the Service, creating an account, starting a trial, or purchasing a subscription, you agree to these Terms and to our Privacy Policy. If you do not agree, you may not use the Service.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into these Terms. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization.
You are responsible for the accuracy of account information, for keeping login credentials secure, and for all activity that occurs under your account. You must notify us promptly if you believe your account has been compromised.
3. Communications
We may send you service messages, onboarding messages, product updates, billing notices, and security notices. We may also send marketing emails where permitted by law. You can opt out of marketing emails by using the unsubscribe link or contacting us, but you may still receive transactional or security-related messages.
4. Subscriptions, Credits, and Billing
Some parts of the Service are provided through free plans, trials, paid subscriptions, usage credits, or add-on credit packs. Plan limits, included credits, draft limits, audit limits, publishing limits, and prices are shown at checkout or in the product.
Subscriptions are billed in advance on a recurring basis unless cancelled. Paid plans may renew automatically until you cancel through the billing portal or by contacting support. You authorize VibeSEO and its payment processors to charge applicable fees, taxes, and renewal amounts using the payment method you provide.
Credits and plan allowances are product usage units. Unless stated otherwise at purchase, unused monthly credits do not roll over after the end of the billing period, have no cash value, and may not be transferred outside your account.
5. Trials, Cancellations, and Refunds
We may offer free plans, trial periods, trial articles, promotional credits, or other limited access at our discretion. Trial availability, limits, and duration may change at any time.
You may cancel a subscription renewal at any time. Cancellation stops future renewals but does not automatically refund fees already paid. Unless required by law or stated separately at purchase, refunds are limited to unused credits from the original purchase. Used credits, consumed plan allowances, subscriptions after the applicable billing period has started, and other fees are non-refundable. If we choose to issue a refund outside this policy, doing so does not create an obligation to issue future refunds.
6. Customer Content and Website Access
The Service allows you to submit, connect, crawl, analyze, generate, review, publish, store, and otherwise process domains, website pages, business descriptions, keywords, analytics data, Search Console data, draft articles, published articles, images, metadata, settings, and other materials ("Customer Content").
You retain ownership of Customer Content. You grant VibeSEO a worldwide, non-exclusive, royalty-free license to host, copy, process, analyze, transform, display, transmit, and create derivative materials from Customer Content as needed to provide, secure, maintain, improve, and support the Service.
You represent that you have the rights and permissions needed to provide Customer Content and to authorize VibeSEO to crawl, analyze, process, and publish it. You are responsible for reviewing the legality, accuracy, suitability, and brand fit of Customer Content and generated outputs before publishing or using them.
7. AI-Generated Drafts and SEO Outputs
VibeSEO uses automated systems and third-party providers to analyze websites, identify SEO opportunities, draft articles, suggest titles, metadata, FAQs, internal links, and other SEO materials. AI-generated outputs may be incomplete, inaccurate, duplicative, outdated, or unsuitable for your business.
The Service is designed to support human review. You are responsible for approving, editing, rejecting, fact-checking, and legally reviewing any draft, recommendation, keyword, report, or published page before relying on it. VibeSEO does not guarantee search rankings, traffic, indexing, revenue, conversions, or any particular SEO result.
8. Publishing, Integrations, and Third-Party Services
VibeSEO may publish approved content to a hosted VibeSEO blog, a shared VibeSEO host, a customer domain, or supported third-party platforms and integrations. You are responsible for domain configuration, DNS records, CMS permissions, publication approvals, and ensuring published content complies with your obligations.
The Service may depend on third-party services such as payment processors, hosting providers, AI providers, analytics tools, SEO data providers, Google Search Console, CMS platforms, email providers, and infrastructure vendors. We are not responsible for third-party services, their availability, their data, or their terms.
9. Acceptable Use
You may not use the Service to violate law, infringe rights, mislead consumers, publish unlawful or harmful content, attack or overload systems, bypass limits, scrape or reverse engineer the Service, resell access without permission, interfere with other users, or submit malware, spam, phishing content, or deceptive SEO schemes.
You may not use the Service to generate or publish content for illegal products or services, content that exploits or harms minors, or content that violates applicable platform, search engine, advertising, or CMS policies. We may suspend or terminate accounts that we believe violate these Terms or create risk for VibeSEO, users, partners, or third parties.
10. Intellectual Property
The Service, software, workflows, interfaces, templates, prompts, designs, trademarks, logos, and related technology are owned by VibeSEO or its licensors and are protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
You may not use VibeSEO names, marks, branding, or trade dress without prior written permission, except to identify yourself as a VibeSEO customer in a truthful and non-misleading way.
11. Feedback
If you send us suggestions, ideas, bug reports, feature requests, or other feedback, you grant VibeSEO a perpetual, irrevocable, worldwide, royalty-free right to use, modify, publish, and commercialize that feedback without restriction or compensation to you.
12. Service Changes and Availability
We may change, suspend, discontinue, limit, or modify any part of the Service at any time, including features, integrations, plans, limits, pricing, and availability. We will try to provide reasonable notice for material changes when practical.
We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times. Maintenance, vendor outages, infrastructure issues, crawler restrictions, rate limits, or changes by search engines and third-party platforms may affect the Service.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, create risk, fail to pay fees, or use the Service in a way that may harm VibeSEO, users, third-party services, or the public.
After termination, provisions that by their nature should survive will continue to apply, including ownership, payment obligations, disclaimers, limitations of liability, indemnity, and dispute-related provisions.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESEO DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.
VIBESEO DOES NOT WARRANT THAT GENERATED CONTENT, KEYWORD DATA, TRAFFIC ESTIMATES, RANKING SIGNALS, CRAWL DATA, THIRD-PARTY DATA, OR SEO RECOMMENDATIONS WILL BE ACCURATE, COMPLETE, CURRENT, UNIQUE, LAWFUL, OR SUITABLE FOR YOUR USE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESEO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL, BUSINESS INTERRUPTION, SEARCH RANKING CHANGES, DEINDEXING, PLATFORM PENALTIES, OR CONTENT ERRORS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESEO'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO VIBESEO FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100 IF YOU DID NOT PAY FOR THE SERVICE.
16. Indemnity
You agree to defend, indemnify, and hold harmless VibeSEO and its affiliates, officers, employees, contractors, agents, suppliers, and licensors from claims, damages, liabilities, losses, and expenses arising from your Customer Content, your use of the Service, your published content, your domains or integrations, your breach of these Terms, or your violation of law or third-party rights.
17. Governing Law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules, unless mandatory law gives you additional rights. If VibeSEO identifies a different governing law in an order form, invoice, or enterprise agreement signed by both parties, that document controls for that transaction.
18. Changes to These Terms
We may update these Terms from time to time by posting a revised version on this page. The revised Terms become effective when posted unless stated otherwise. Your continued use of the Service after the effective date means you accept the revised Terms.
